Announcement on Prequalification

建設中國海南國際文物藝術品交易中心和三亞文化藝術中心，是落實三亞市第八次黨代會關于“六個標桿”建設部署的重要舉措，以及三亞市“十四五”期間發(fā)展文化產業(yè)和提升公共文化服務水平的重大安排。為高標準、高質量規(guī)劃建設中國海南國際文物藝術品交易中心和三亞文化藝術中心，打造新時代城市濱海會客廳和全球城市卓越水岸，特舉辦此次方案征集工作。

The construction of International Cultural Relics and Artworks Trading Center of Hainan, China and Sanya Culture and Art Center is an important initiative to implement the construction and deployment of "six benchmarks" at the 8th Party Congress of Sanya, as well as a major step to develop cultural industry and improve the standard of public cultural services of Sanya City during the "14th Five-Year Plan" period. The Call for Proposals is hereby held with the purpose to plan and construct the International Cultural Relics and Artworks Trading Center of Hainan, China and Sanya Culture and Art Center of high standards and high quality, and to create a coastal living room in the city for the new era and a remarkable waterfront as an international city.

本次方案征集采用公開征集的方式進行，邀請國內外具有豐富的類似項目經驗的設計機構報名申請應征，第一步通過資格審查的方式（預審）確定8個應征人，第二步由通過資格審查的應征人根據征集文件的要求編制設計方案。

The Call for Proposals will be carried out in an open call manner, by inviting design institutions at home and abroad with rich experiences in similar projects to apply for prequalification. The first step will determine 8 applicants through Review for Qualifications (prequalification), and in the second step, the applicants who have passed the Review for Qualifications will propose the design schemes according to the requirements of the documents of the Call.

01項目概況Project Brief

（一）項目名稱：三亞國際藝術港建筑設計方案國際征集

(I) Project Name: Call for Proposals of Architectural Design for Sanya International Art Harbor 

（二）項目地點及建設規(guī)模

(II) Project Location and Construction Scale

1.項目地點：三亞文化商務區(qū)（空間設計范圍）位于三亞灣鳳凰海岸南端，三亞河口區(qū)域，北至漁港街，南至建港路，東至勝利路。三亞國際藝術港（建筑設計范圍）位于三亞文化商務區(qū)YGHA01-01-04/07/09地塊。

1. Project location: Sanya Culture and Business District (scope of space design) is located at the Southern tip of Fenghuang Coast of Sanya Bay, Sanya estuary area, with its Northern boundary at Yugang Street, Southern boundary at Jiangang Road and Eastern boundary at Shengli Road. Sanya International Art Harbor (scope of architectural design) is located at YGHA01-01-04/07/09 plots in Sanya Culture and Business District.

2.用地面積：三亞文化商務區(qū)范圍26.7公頃，其中可開發(fā)建設用地面積16.4公頃。三亞國際藝術港用地約5.8公頃。

2. Land area: Sanya Culture and Business District covers an area of 26.7 hectares, of which 16.4 hectares is available for development and construction. Sanya International Art Harbor covers a land area of about 5.8 hectares.

3.建設內容：三亞國際藝術港的主要功能為中國海南國際文物藝術品交易中心和三亞文化藝術中心。中國海南國際文物藝術品交易中心包含展覽展示、文物藝術品交易、藝術品機構辦公和文物藝術品庫房等功能。三亞文化藝術中心包含歌劇廳、多功能廳及其他配套功能。三亞文化商務區(qū)將以三亞國際藝術港為核心，復合開發(fā)文化藝術、商務辦公、濱海商業(yè)、高端酒店、休閑娛樂、公共綠地、碼頭等功能，通過整體打造，發(fā)展成為三亞文化藝術的地標性區(qū)域和重要的城市濱水公共空間。具體建設內容以征集文件中的設計任務書為準。

3. Contents of Construction: The main functions of Sanya International Art Harbor include International Cultural Relics and Artworks Trading Center of Hainan, China and Sanya Culture and Art Center. The International Cultural Relics and Artworks Trading Center of Hainan, China is featured with functions of exhibition and display, cultural relics and artworks trading, offices for organizations of artworks and cultural relics and artworks warehouse, etc. Sanya Culture and Art Center includes opera hall, multi-function hall and other ancillary functions. With Sanya International Art Harbor as the core, Sanya Culture and Business District will compose of the functions of culture and art, business office, bayfront commerce, high-end hotels, leisure and entertainment, public green space, wharf, etc., and evolve into an iconic area of Sanya culture and art and an important urban waterfront public space in an integrated approach. The specific construction contents shall be subject to the design book in the documents of the Call.

4.建筑面積：三亞文化商務區(qū)建筑面積40.9萬平方米（計容），三亞國際藝術港建筑面積8.7萬平方米（計容）。

4. Building area: Sanya Culture and Business District covers a building area of 409,000 square meters (by Floor Area Ratio Method), and Sanya International Art Harbor covers a building area of 87,000 square meters (by Floor Area Ratio Method).

5.建筑高度：三亞文化商務區(qū)標志性塔樓建筑高度不大于220米。三亞國際藝術港建筑高度不大于24米，局部不超過35米，根據方案需要，可突破限高要求，原則上不追求以建筑高度體現標志性。

5. Building height: The building height of the iconic tower in Sanya Culture and Business District shall not exceed 220m. The building height of Sanya International Art Harbor shall not be greater than 24m, with some parts not exceeding 35m. According to the requirements of the scheme, exception of the height limit can be allowed, but in principle, the building height shall not be pursued to reflect any landmark significance.

(IV) Contents of Design

1.三亞文化商務區(qū)空間設計：在鳳凰海岸及環(huán)河口地區(qū)的產業(yè)定位、生態(tài)定位、文化定位的研究基礎上，提出三亞文化商務區(qū)的產業(yè)及功能策劃、單元形態(tài)、建筑風貌、地下地上空間、公共空間、交通流線等設計內容。

1. Space Design of Sanya Culture and Business District: Based on the research of industry positioning, ecological and cultural orientations of Fenghuang coast and surrounding the estuary area, the design contents of Sanya Culture and Business District are put forward, such as industry and function planning, module form, architectural style, underground and above-ground space, public space, and traffic flow dynamic scheme, etc.

2.三亞國際藝術港建筑方案設計：包括用地紅線范圍內的總平面圖設計、建筑設計、功能布局、流線組織、重要空間的室內設計、室外景觀設計等設計內容。

2. The architectural design of Sanya International Art Harbor includes: the general floor plan design, architectural design, functional layout, traffic dynamics organization, interior design of important spaces, outdoor landscape design and other design contents within the red-lined boundary of land use.

（五）設計周期：應征階段設計周期為89天。計劃在2022年5月27日（北京時間，下同）發(fā)出征集文件，2022年8月24日應征人遞交應征成果。

(V) Cycle of Design: The turnaround period of design at the Proposal Phase is 89 days. It is planned to release the documents of the Call on May 27, 2022 (Beijing time, the same hereinafter), and Applicants shall submit deliverables on August 24, 2022.

（六）資格審查的方式：有限數量制。參加征集活動的應征人（含聯合體應征人）的數量限定為8個。

(VI) Method of Review for Qualifications: Limited number of applicants permitted. The number of Applicants for such Call (including Consortium Applicants) is limited to 8. 

（七）獎項設置：優(yōu)勝獎3個。

02應征申請人資格條件Eligibility and Qualifications of Applicants

（一）應征申請人應為合法注冊的法人實體或由合法注冊的法人實體組成的項目聯合體。

(I) The Applicant shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws.

（二）中華人民共和國境內的設計機構須具有建筑行業(yè)（建筑工程）設計甲級資質或建筑行業(yè)設計甲級資質或工程設計綜合甲級資質；中華人民共和國境外的設計機構須具有所在國頒發(fā)的從事建筑設計的相應資格。港澳臺設計機構的資格要求應參照境外設計機構資格要求的規(guī)定。

(II) The Applicant (design institution) within the territory of the People's Republic of China shall be at least certified with one of the following: Grade A qualification for design in the architectural industry (architectural engineering) or Grade A qualification for design in the architectural industry or Comprehensive Grade A qualification for engineering design; the Applicant (design institution) outside the territory of the People's Republic of China shall hold corresponding qualifications issued by governmental authorities in its residence country or region for engaging in architectural design. The requirements of qualifications for design institutions from Hong Kong, Macau and Taiwan shall refer to the requirements of qualifications for design institutions outside the territory of the People’s Republic of China.

（三）上述具有相應資質/資格的設計機構可單獨提出資格預審申請，也可組成聯合體共同提出資格預審申請，但需以聯合體協議書明確聯合體的牽頭單位和各自職責。組成項目聯合體的各成員單位不得再以自己的名義單獨進行資格預審申請，也不得同時加入本項目其它聯合體進行資格預審申請。

(III) The above design institutions with corresponding credentials/qualifications can apply for prequalification individually, or can form a consortium to apply for prequalification, but the design institutions applying for prequalification in the capacity of a consortium shall specify the lead partner and their respective responsibilities of each partner by a Consortium Agreement. Any partner of the Consortium shall neither individually apply for prequalification in its own capacity, nor concurrently apply for the Prequalification as a partner of another Consortium in the Proposal Project.

（四）應征申請人應具有與本項目的功能性質相類似的設計經驗。

(IV) The Applicant shall have had design experiences similar in functions and nature to the Proposal Project.

（五）應征申請人參加本次活動的設計人員應是其機構正式在冊人員，首席設計師必須由應征申請人單位中主持過類似項目（劇院、音樂廳、藝術品交易中心、美術館或其他文化公共建筑等）的設計師擔任。

(V) The designers who are going to take part in the Call must be incumbent officially documented employees of the Applicant. The Chief Designer must have experience in leading comparable design projects (theater, concert hall, art trading center, art gallery or other cultural public buildings, etc.) at the Applicant. 

說明：除聯合體的成員外，參加征集的應征人之間不應存在關聯關系。

Note: Except for partners of a Consortium, the Applicants in the Call shall not constitute or bear any affiliations. 

符合以上條件的應征申請人可自2022年5月6日至2022年5月18日，每天上午9時00分至11時30分，下午13時30分至16時00分在組織單位進行報名登記后獲取資格預審文件。

Any Applicant who meets the aforesaid criteria may sign up and register with the Organizer and obtain prequalification documents from 9:00 a.m. to 11:30 a.m. and 13:30 to 16:00 in the afternoon each day, from May 6, 2022 to May 18, 2022.

03征集活動時間安排Timetable of the Call

（一）資格預審階段（2022年5月6日～2022年5月26日）

(I) Prequalification Phase (May 6,2022~May 26,2022)

（二）應征階段（設計階段）（2022年5月27日～2022年8月24日）

(II) Proposal Phase（Design Phase）(May 27,2022~August 24, 2022)

以上時間為計劃時間，若有調整將另行通知。

The date and time given above is scheduled date and time and may be subject to changes until further notice.

特別提示：境外應征申請人負責本項目主要人員請?zhí)崆白龊煤炞C準備，以便入圍后按期赴三亞參加項目介紹會及現場踏勘。應征人首席設計師原則上必須參加現場踏勘，但因新型冠狀病毒肺炎疫情，無法參加現場踏勘的，應提前向主辦單位作出書面說明。

Warm Tip: Foreign applicants should get visas ready in advance for key staff members who will take responsibility for the Proposal Project, so that they will be able to arrive in Sanya for the project briefing and site as scheduled after being shortlisted. In principle, the Chief Designer from the Applicant must be present for site survey. Nevertheless, if such presence in the site survey can not be realized due to the COVID-19 pandemic, a written explanation to the Sponsor shall be made in advance.

05資格預審文件的獲取Obtaining of Prequalification Documents

應征申請人請于2022年5月6日至2022年5月18日，每天上午9時00分至11時30分，下午13時30分至16時00分在組織單位報名登記，并在其網站（http://www.bkpmzb.com/）上免費下載資格預審文件。只有符合條件，并在組織單位報名登記的應征申請人才能獲得下載資格預審文件的密碼，正式參加資格預審。

The Applicant shall sign up and register with the Organizer from 9:00 a.m. to 11:30a.m, from 13:30 to 16:00 in the afternoon each day, from May 6,2022 to May 18,2022, and download the prequalification documents from its website（http://www.bkpmzb.com/）for free. Only those Applicants that meet criteria and have signed up and registered with the Organizer will receive a password for downloading prequalification documents and be eligible for prequalification. 

報名登記的程序：①在組織單位網站上下載報名表；②填寫報名表后，將底稿（doc格式）及加蓋單位印章的掃描件（pdf格式）以電子郵件的方式發(fā)回；③組織單位確認應征申請人的報名資格并進行登記。

Signup and Registration steps: ① The Applicant downloads the registration form from the website of the Organizer; ②The Applicant completes the registration form and returns the original document (in doc format) and a scanned copy affixed with the company seal (in pdf format) to the Organizer by email; ③ the Organizer confirms the eligibility of the Applicant and gets it registered.

06資格預審申請文件的遞交時間Submission Deadline of Application Documents for Prequalification

應征申請人請于2022年5月20日16時00分前，將資格預審申請文件的表格部分（doc格式）先行通過電子郵件的方式發(fā)送給組織單位，并請于2022年5月23日12時00分前將資格預審申請文件的文本文件（1正1副）及電子文件（2套）送交組織單位。

The Applicant is required to send those forms (in doc format) in the application documents for prequalification to the Organizer by email first prior to 16:00 on May 20,2022, and then submit textual documents in the application documents for prequalification (1 original and 1 copy) and electronic files (2 sets) to the Organizer no later than 12:00 on May 23,2022.

07應征補償費及獎項的設置Compensations and Prizes for Application

（一）提交了合格應征方案的應征人將獲得應征補償費，應征補償費為人民幣120萬元/應征人（含中國境內、外應繳納的各項稅費）。但對于未按規(guī)定時間提交應征文件或其應征文件按征集文件規(guī)定不被接受或應征資格被取消的應征人，承辦單位將不支付應征補償費。

(I) The applicants who have submitted proper proposals will receive a compensation of RMB 1,200,000 (inclusive of various taxes or levies payable both inside and outside China). However, the Undertaker will not pay any compensation to any Applicant that has failed to submit a proposal within the specified deadline or that has submitted a proposal that is considered unacceptable in light of the requirements of the documents of the Call or that has been disqualified. 

（二）應征設計方案評審委員會將從應征設計方案中評選出3個優(yōu)勝獎，獲獎的3個應征人須按照主辦單位（承辦單位）的深化設計要求對其提交的設計成果進行優(yōu)化和深化，深化費用為人民幣150萬元/應征人（含中國境內、外應繳納的各項稅費）。

(II) The Evaluation Committee of the design proposals will select three winners from the submissions. The three winning Applicants shall optimize and deepen their design deliverables according to the detailed design requirements of the Sponsor (Undertaker). The compensation for detailed design is RMB 1.5 million/Applicant (inclusive of various taxes or levies payable inside and outside China).

（三）獲得優(yōu)勝獎的3個應征人對各自的設計方案進行深化后提交主辦單位審議。主辦單位可選擇其中一個方案確定為中標候選方案。中標人的設計費中將等額扣除已支付的深化設計費用150萬元。

(III) The three winners who have won the prize shall further deepen their own design proposals and submit them to the Sponsor for review. The Sponsor may choose one of the proposals to determine the awarded candidate. The awarded bidder's design fee will be equal to the amount after deducting RMB 1.5 million, the detailed design fee already paid.

08其它條款Miscellaneous

（一）本次征集活動設計成果提交日期為2022年8月24日。

(I) The deadline for submission of design deliverables in this Call is August 24,2022.

（二）知識產權

(II) Intellectual Property Rights

1.應征人擁有設計方案的著作權（版權）。經主辦單位（承辦單位）書面許可后，應征人可通過傳播媒介、專業(yè)雜志、書刊或其他形式評價、展示其應征作品。應征人不得將應征設計方案用于本征集項目以外的其他任何項目。

1. The Applicant owns the authorship (copyright) of the design proposal. With the written permission of the Sponsor (Undertaker), the Applicant may comment on and display the proposal works for Application via media communications, trade magazines, publications or by other means. The Applicant shall not use the design proposals for any project other than this project herein.

2.應征人應保證其提交的全部設計文件在中國境內或境外沒有且不會侵犯任何其他人的知識產權（包括但不限于著作權、專利權）或專有技術或商業(yè)秘密。如果其應征人的設計文件使用或包含任何其他人的知識產權或專有技術或商業(yè)秘密，應征人應已經獲得權利人的合法、有效、充分的授權。應征人因侵犯他人知識產權或專有技術或商業(yè)秘密所引起的全部賠償責任應由應征人承擔。

2. The Applicant shall ensure that all design documents submitted do not and will not infringe the IPR (intellectual property rights) (including but not limited to copyright and patent rights), proprietary technologies or business secrets of others within or outside the People’s Republic of China. If the design documents of the Applicant use or include IPR or proprietary technologies or trade secrets of others, the Applicant shall have already obtained legitimate, valid and sufficient authorization from the right holders. The Applicant shall take all liabilities for any compensations arising from infringement upon IPR or proprietary technologies or trade secrets of others.

3. 主辦單位（承辦單位）擁有應征設計方案的使用權，可對應征設計方案匯編、印刷、出版和展覽，可通過傳播媒介、專業(yè)雜志、書刊或其他形式評價、展示、宣傳應征作品。主辦單位（承辦單位）有權在項目的規(guī)劃和設計中或在設計方案調整綜合時，全部或部分使用應征設計方案的內容，也可以對應征設計方案進行修改。未經應征人書面同意，主辦單位（承辦單位）不得將應征設計方案用于本次方案征集項目范圍以外的其他建設項目。

3. The Sponsor (Undertaker) has the right of use over the design proposals submitted by all Applicants, may also compile, print, publish and exhibit the design proposals, or comment on, display and publicize the proposal works for Application via media communications, trade magazines, publications or by other means. The Sponsor (Undertaker) has the right to use any design proposal in its entirety or partially in the planning and design of the Proposal Project or in modification or consolidation of the design proposals, or to revise any design proposal. Without the written consent of the Applicant, the Sponsor (Undertaker) shall use the design proposals for other construction projects beyond the scope of the project in this Call.

4.聯合體應征人合作完成的設計方案，其知識產權由聯合體成員共同所有。

4. The intellectual property rights of the design proposals completed by the Consortium Applicants shall be jointly owned by the Consortium partners.

（三）本次征集活動中的所有文件及往來信函均應使用中文書寫。

(III) All documents and correspondences related to the Call shall be written in Chinese. 

（四）設計機構所獲的應征補償費或深化費用的稅金（含中國境內、外應繳納的各項稅費）和在咨詢過程中發(fā)生的一切費用自理。

(IV) Any taxes imposed on the compensations for applications or for detailed design paid to the Applicant (inclusive of any taxes or levies payable inside and outside China) and any costs arising from the consulting shall be borne by the Applicant. 

（五）參加本次活動的應征申請人均被視為承認本公告的所有條款。

(V) By participating in the Call, the Applicant is deemed to have acknowledged and accepted all terms and conditions contained in the Announcement herein. 

（六）三亞市人民政府擁有本次公告的解釋權。

(VI) The Sanya Municipal People's Government reserves the right of interpretation of the Announcement. 

（七）本次征集活動本身及與本次活動相關的文件所適用的法律和法規(guī)僅為中華人民共和國的法律和法規(guī)。

(VII) The Call per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.
