Chapter I Announcement on Prequalification
德州市自然資源局作為主辦單位，德州溝盤河片區(qū)綜合開發(fā)有限公司作為承辦單位現(xiàn)舉辦“德州市溝盤河片區(qū)城市設(shè)計方案國際征集”活動。本次方案征集活動將公開邀請具有相關(guān)規(guī)劃設(shè)計經(jīng)驗的設(shè)計機構(gòu)前來申請應(yīng)征，提交資格預(yù)審申請文件（以下簡稱“申請文件”）。通過資格預(yù)審選取4個應(yīng)征人參加征集活動，并提交應(yīng)征設(shè)計成果。
Dezhou Natural Resources Bureau,as the Sponsor,and Dezhou Goupanhe Area Comprehensive Development Co.,Ltd.,as the Organizer,are currently holding the“International Solicitation of Urban Design Proposals for the Goupanhe Area in Dezhou City.”Design entities worldwide with related planning and design experience are publicly invited to participate and submit the Application Documents for Prequalification(hereinafter referred to as“Application Documents”).The Sponsor will select four final applicants as Participants for solicitation of proposals and for them to further submit their design proposals for response.

1.1項目名稱：德州市溝盤河片區(qū)城市設(shè)計方案國際征集
1.1 Project Name:International Solicitation of Urban Design Proposals for the Goupanhe Area in Dezhou City
1.2項目位置：該項目位于東風(fēng)路以南、岔河?xùn)|大道以東、減河以西。
1.2 Project location:The Project is located in the south of Dongfeng Road,east of Chahedong Avenue,and west of Jianhe River.
1.3規(guī)劃設(shè)計范圍：本次規(guī)劃范圍包含兩個空間層次：一是總體城市設(shè)計范圍，總占地面積約26.12平方公里，為德州市南部溝盤河片區(qū)；二是核心區(qū)范圍，核心區(qū)占地面積13.13平方公里，為水系周邊及城市軸線重要區(qū)域。
1.3 Planning and design scope:The planning scope of this Project includes two spatial levels:First,the overall urban design scope,covering a total area of approximately 26.12 square kilometers,focuses on the Goupanhe Area in the south of Dezhou City.Second,the scope of core area,covering an area of 13.13 square kilometers,focuses on important regions around the water system and along the urban axis.
1.4規(guī)劃設(shè)計任務(wù)：重點研究規(guī)劃定位，發(fā)展目標(biāo)、產(chǎn)業(yè)研究、空間布局、發(fā)展模式等方面，主要內(nèi)容包含不僅限以下內(nèi)容：根據(jù)現(xiàn)狀條件和區(qū)域分析，明確規(guī)劃區(qū)的定位；提供國際案例借鑒分析，明確發(fā)展目標(biāo)和發(fā)展策略/設(shè)計理念；優(yōu)化功能分區(qū)，細(xì)化核心片區(qū)用地布局；劃定城市生態(tài)格局；研究規(guī)劃區(qū)總體城市風(fēng)貌和設(shè)計形態(tài)；規(guī)劃城市天際線；確定重點區(qū)域建筑設(shè)計意向及標(biāo)志性建筑物、構(gòu)筑物設(shè)計意向；按要求進(jìn)行重要公共服務(wù)設(shè)施及大型市政服務(wù)設(shè)施布局；進(jìn)行綜合交通研究，處理好水系與車行、步行交通的有機銜接。
1.4 Design Specifications:To focus on planning and orientation,development objectives,industrial research,spatial layout,and development mode,including,without limitation:defining the orientation of the planned area based on the current situation and regional analysis;providing international case studies and clarifying development objectives and development strategies/design concepts;optimizing functional zoning,refining the land layout of core areas;demarcating the urban ecological pattern;studying the overall urban landscape and design form of the planned area;planning the city skyline;determining the architectural design intention in key areas and the design plans for iconic buildings or structures;identifying layout of important public service facilities and large municipal service facilities as required;and conducting integrated traffic research,to properly ensure the organic connection between water systems,vehicle lanes,and pedestrian traffic.

4.應(yīng)征申請人的資格
4.Eligibility and Qualifications of Applicants
4.1應(yīng)征申請人（以下簡稱“申請人”）應(yīng)為合法注冊的法人實體或由合法注冊的法人實體組成的項目聯(lián)合體，且應(yīng)具有與本項目的功能性質(zhì)相類似的設(shè)計經(jīng)驗和策劃經(jīng)驗。
4.1 The Applicant shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws,and shall have design and planning experience in a project with the similar functional nature of this Project.
4.2應(yīng)征申請人應(yīng)具有承擔(dān)本征集項目城鄉(xiāng)規(guī)劃或建筑設(shè)計以及風(fēng)景園林設(shè)計的相應(yīng)資質(zhì)或資格，同時須具有產(chǎn)業(yè)發(fā)展研究和商業(yè)運營策劃的專業(yè)技術(shù)能力。
4.2 Applicants shall have the corresponding eligibility or qualifications to undertake urban and rural planning,or architectural design and landscape design of this Project,and shall also have professional technical capabilities in industrial development research and commercial operation planning.
4.2.1城鄉(xiāng)規(guī)劃或建筑設(shè)計以及風(fēng)景園林設(shè)計的相應(yīng)資質(zhì)或資格要求如下：
4.2.1 The requirements for the corresponding eligibility or qualifications to undertake the urban and rural planning,or architectural design and landscape design are as follows:
?。?）中華人民共和國境內(nèi)的設(shè)計機構(gòu)應(yīng)具有政府有關(guān)行政主管部門核發(fā)的：城鄉(xiāng)規(guī)劃編制甲級資質(zhì)或建筑行業(yè)（建筑工程）設(shè)計甲級資質(zhì)或風(fēng)景園林工程設(shè)計專項甲級資質(zhì)或工程設(shè)計綜合甲級資質(zhì)；
?。?）Design entities within the People’s Republic of China should possess the following qualifications issued by the relevant administrative departments of the government:Grade-A qualification for urban and rural planning,or Grade-A qualification for architectural design(architectural engineering),or Grade-A qualification for landscape engineering design or Grade-A qualification for comprehensive engineering design.

?。?）Design entities outside the People's Republic of China should have a practice license or business license for urban planning or architectural design or landscape design in accordance with the national or local administrative regulations.
4.2.2產(chǎn)業(yè)發(fā)展研究和商業(yè)運營策劃專業(yè)技術(shù)能力要求如下：
4.2.2 The requirements for professional technical capabilities in industrial development research and commercial operation planning are as follows:
應(yīng)征申請人應(yīng)具有產(chǎn)業(yè)發(fā)展研究和商業(yè)運營策劃的項目業(yè)績，并能提供與此相關(guān)的證明資料。
Applicants shall have project achievements in industrial development research and commercial operation planning,and be able to provide relevant supporting materials.
4.3香港、澳門特別行政區(qū)和臺灣地區(qū)的規(guī)劃設(shè)計機構(gòu)的資格要求參照境外設(shè)計機構(gòu)資格要求的規(guī)定。
4.3 The qualifications for planning and design entities from Hong Kong and Macau Special Administrative Regions as well as Taiwan shall refer to the requirements of qualifications for design entities outside the People’s Republic of China.
4.4本項目接受聯(lián)合體應(yīng)征。
4.4 This Project accepts applications from Consortia.
4.4.1聯(lián)合體的各成員應(yīng)共同簽署一份聯(lián)合體協(xié)議。
4.4.1 Members of a Consortium shall jointly sign a consortium agreement.
4.4.2組成項目聯(lián)合體的各成員單位不得再以自己的名義單獨申請資格預(yù)審，也不得同時加入本項目其它聯(lián)合體申請資格預(yù)審。
4.4.2 Any partner of the Consortium shall neither individually apply for the Prequalification in its own capacity,nor concurrently apply for the Prequalification as a partner of another Consortium.
4.5除聯(lián)合體內(nèi)部的成員外，參加征集的應(yīng)征人之間不應(yīng)存在關(guān)聯(lián)關(guān)系。
4.5 Except for partners of a Consortium,the Participants in the solicitation shall not constitute or bear any affiliations.
5.資格預(yù)審文件的獲取

本項目的資格預(yù)審文件在北京科技園拍賣招標(biāo)有限公司網(wǎng)站下載。
The Prequalification Documents for this Project can be downloaded from the website of Beijing Science Park Auction&Tender Co.,Ltd.
有意向參加應(yīng)征的申請人需先在北京科技園拍賣招標(biāo)有限公司網(wǎng)站（www.bkpmzb.com）下載資格預(yù)審文件領(lǐng)取登記表，填寫完成后以Word版本E-mail至征集指定郵箱kjysanbu 163.com或遞交至北京科技園拍賣招標(biāo)有限公司，承辦單位收到登記表后，再將資格預(yù)審文件的下載密碼發(fā)送給申請人。
Applicants who intend to participate in the solicitation for design proposals must first download the registration form from the website of Beijing Science Park Auction&Tender Co.,Ltd.(www.bkpmzb.com).After completing the registration form,applicants should email the Word version to kjysanbu 163.com or submit it to Beijing Science Park Auction&Tender Co.,Ltd.After receiving the registration form,the Organizer will send the download password of the Prequalification Documents to the applicants.
獲取資格預(yù)審文件的時間為2023年6月5日至2023年6月10日17:00（中國北京時間，下同）。北京科技園拍賣招標(biāo)有限公司網(wǎng)站將于2023年6月5日開通。
The time for obtaining Prequalification Documents is from Jun.5th,2023 to 17:00 on Jun.10th,2023(Beijing Time,the same below).The website of Beijing Science Park Auction&Tender Co.,Ltd.will be accessible on Jun.5th,2023.
6.申請文件的遞交
6.Submission of Application Documents
申請文件遞交的截止時間為2023年6月16日下午17時00分，申請人應(yīng)在遞交截止時間之前將申請文件遞交至征集組織機構(gòu)。主辦單位和征集組織機構(gòu)將拒絕接收逾期送達(dá)的申請文件。
The deadline for submission of application documents is 17:00 on Jun.16th,2023.Applicants shall submit such documents to the Organizer of Solicitation before the deadline.The Sponsor and the Organizer of Solicitation will reject any such documents that arrive after the specified deadline.
7.資格預(yù)審公告發(fā)布媒體
7.Media Releasing Announcement on Prequalification
本公告在中國招標(biāo)投標(biāo)公共服務(wù)平臺（www.cebpubservice.com）、中國政府采購網(wǎng)（www.ccgp.gov.cn）、北京科技園拍賣招標(biāo)有限公司網(wǎng)站（www.bkpmzb.com）同時發(fā)布。本公告的修改、補充以在以上網(wǎng)站發(fā)布的內(nèi)容為準(zhǔn)。
This announcement will be published on the China Tendering and Bidding Public Service Platform(www.cebpubservice.com),China Government Procurement Network(www.ccgp.gov.cn),and the website of Beijing Science Park Auction&Tender Co.,Ltd.(www.bkpmzb.com)at the same time.The amendment and supplement of the announcement shall be subject to the contents released via the websites aforementioned.

8.1知識產(chǎn)權(quán)
8.1 Intellectual Property Rights(IPRs)
8.1.1本次方案征集中接收的所有有效的應(yīng)征文件（包括A3版面設(shè)計文冊、A0標(biāo)準(zhǔn)輕質(zhì)展板、電子文件、模型和應(yīng)征設(shè)計方案著作權(quán)聲明等）均不退回。
8.1.1 All valid response proposals(including the A3 sized design book,A0 standard lightweight exhibition panel,electronic documents,models,and the Copyright Statement of Design Proposals)received in this solicitation will not be returned.
8.1.2應(yīng)征設(shè)計文件和設(shè)計成果的知識產(chǎn)權(quán)由主辦單位/承辦單位與應(yīng)征人共同享有。
8.1.2 The intellectual property rights of the Design Proposals and design results shall be commonly owned by the Sponsor/Organizer and the Participants.
8.1.3應(yīng)征人對其應(yīng)征設(shè)計文件享有署名權(quán)，在征得主辦單位/承辦單位書面同意后可通過傳播媒介、專業(yè)雜志、書刊或其他形式評價、展示其應(yīng)征設(shè)計文件的相關(guān)內(nèi)容。除應(yīng)征人的設(shè)計標(biāo)準(zhǔn)、設(shè)計導(dǎo)則和繪圖元素以外，應(yīng)征人不得將應(yīng)征設(shè)計文件及設(shè)計成果用于其他的設(shè)計項目。
8.1.3 Participants hold the right of authorship for their Design Proposals and can comment on and display such Design Proposals in the forms of media communications,trade magazines,publications among others after granted with the Sponsor’s/Organizer’s consent in writing.The Participants shall not use the Design Proposals and design results on other design projects,except the Participants’design standards,design guides and principles,and drawing elements.
8.1.4應(yīng)征人應(yīng)保證提交的應(yīng)征設(shè)計文件及設(shè)計成果在中華人民共和國境內(nèi)或境外沒有且不會侵犯任何其他人的知識產(chǎn)權(quán)（包括但不限于著作權(quán)、專利權(quán)）或?qū)Ｓ屑夹g(shù)或商業(yè)秘密。應(yīng)征人應(yīng)保證，如果其應(yīng)征設(shè)計文件使用或包含任何其他人的知識產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密，應(yīng)征人應(yīng)已經(jīng)獲得權(quán)利人的合法、有效、充分的授權(quán)。應(yīng)征人因侵犯他人知識產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密所引起的全部賠償責(zé)任應(yīng)由應(yīng)征人承擔(dān)。
8.1.4 Participants shall ensure that all the submitted Design Proposals and design results have not infringed upon and will not infringe upon IPRs(including but not limited to copyright and patent right)or proprietary technologies or trade secrets of others within or outside the People’s Republic of China.The Participants shall guarantee that if their Design Proposals use or include IPRs or proprietary technologies or trade secrets of others,the Participants shall have already obtained legitimate,valid and sufficient authorization from the right holders.The Participants shall take all liabilities for any compensations arising from infringement upon IPRs or know-how or trade secrets of others.
8.1.5主辦單位/承辦單位有權(quán)在本項目的規(guī)劃設(shè)計中使用應(yīng)征人提交的規(guī)劃設(shè)計成果，主辦單位/承辦單位在項目的規(guī)劃設(shè)計中或在規(guī)劃設(shè)計方案調(diào)整綜合時可以全部或部分使用應(yīng)征規(guī)劃設(shè)計成果的內(nèi)容，也可以對其進(jìn)行修改。主辦單位/承辦單位不得將應(yīng)征設(shè)計文件及設(shè)計成果用于本項目以外的其他項目。
8.1.5 The Sponsor/Organizer has the right to use the planning and design results submitted by the Participants in the planning and design of this Project.The Sponsor/Organizer is allowed to use the Design Proposals in whole or in part in the planning and design of this Project or the adjustment and integration of the planning and design proposals,and has the right to modify them.The Sponsor/Organizer shall not use the Design Proposals and designresults for a purpose other than this Project.
8.1.6主辦單位/承辦單位可以對所有應(yīng)征設(shè)計文件及設(shè)計成果印刷、出版和展覽，并可通過傳播媒介、專業(yè)雜志、書刊或其他形式評價、展示、宣傳應(yīng)征設(shè)計文件及設(shè)計成果，但應(yīng)注明設(shè)計機構(gòu)的名稱。
8.1.6 The Sponsor/Organizer can print,publish and exhibit all the Design Proposals and design results,or comment on,display and publicize the Design Proposals and design results via media communications,trade magazines,publications or by other means.The precondition is indication of the names of design entities for such design.
8.1.7應(yīng)征建筑設(shè)計方案（如果有）的著作權(quán)歸屬于應(yīng)征人，但景觀小品及其建構(gòu)筑物除外。
8.1.7 The copyright of architectural design proposals(if any)shall belong to the Participants,except for landscape embellishments and their structures.
8.2應(yīng)征設(shè)計補償金
8.2 Compensations for Designs Proposals
承辦單位將向按征集文件的要求在規(guī)定的時間內(nèi)提交了有效應(yīng)征文件的應(yīng)征人支付應(yīng)征設(shè)計補償金，金額為人民幣80萬元（含稅）。當(dāng)應(yīng)征人出現(xiàn)下列情況時，承辦單位將不予支付補償金：
The Organizer will pay compensations for design proposals in the amount of RMB 0.8 million(including tax)for any Participant that has submitted valid responsive documents within specified time frame as required per Solicitation Documents.The Organizer will not pay any compensation when Participants are under any of the following circumstances:
?。?）應(yīng)征人未按規(guī)定時間提交應(yīng)征文件；
?。?）Participants fail to submit their response proposals within the specified time;
（2）應(yīng)征人提交的應(yīng)征文件經(jīng)專家委員會評審被認(rèn)定為未對征集文件要求作出實質(zhì)性響應(yīng)；
?。?）The response proposals submitted by Participants are judged,upon the expert review,as not substantially responding to the requirements of the Solicitation Documents;
（3）應(yīng)征人被取消應(yīng)征資格。
?。?）Participants are disqualified.
8.3獎項的設(shè)置
8.3 Awards settings
本次方案征集將評選出2個優(yōu)勝設(shè)計方案，其應(yīng)征設(shè)計方案被選為優(yōu)勝方案的2個應(yīng)征人須根據(jù)主辦單位/承辦單位的優(yōu)化設(shè)計要求對其提交的設(shè)計方案進(jìn)行優(yōu)化，優(yōu)化費用為人民幣20萬元（含稅）。
There will be two winning design proposals in this solicitation.The two Participants whose design proposals are selected as the winning proposals must optimize their respective design proposals according to the requirements of the Sponsor/Organizer.The optimizing fee is RMB 200,000(including tax).
8.4適用法律
8.4 Governing laws
本次征集活動本身及與本次活動相關(guān)的文件所適用的法律和法規(guī)僅為中華人民共和國的法律和法規(guī)。
The solicitation per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.
8.5語言
8.5 Languages
資格預(yù)審文件以及與資格預(yù)審文件相關(guān)的補充文件和澄清文件均使用中文和英文書寫。申請文件應(yīng)使用中文書寫，申請人隨申請文件提供的證明文件和印刷品可以使用另一種語言，但應(yīng)附中文譯本。在中文與其他語言的意思表達(dá)不一致時，以中文為準(zhǔn)。
The language used in the Prequalification Documents and any supplement and clarification documents thereto shall be Chinese and English.Application Documents for Prequalification shall be drafted in Chinese.Another language can be used for the proof documents and printed materials that Applicants provide along with the Application Documents,but the version with Chinese translation shall be attached thereto.In the case of inconsistent expressions in both Chinese and another language,the Chinese version shall prevail.
8.6解釋權(quán)
8.6 Power of interpretation
本次征集活動的最終解釋權(quán)歸主辦單位和承辦單位。
The Sponsor and the Organizer reserve the power of final interpretation in view of the solicitation.
